Terms of Service

By accessing the marketarta.com website (the “Site”) or entering into an engagement with Marketarta OÜ (Registry Code 17453771), you agree to these Terms of Service. If you do not agree, please do not use the Site or sign a statement of work with us.

Marketarta provides marketing, design, and product engineering services as described on the Site, in our published Plans, and in any executed statement of work. The specific deliverables, timeline, and price for each engagement are defined in writing before work begins.

Examples and case studies shown on the Site are illustrative. Past results do not guarantee future outcomes.

Engagements begin once a statement of work is countersigned and the first invoice is paid. Recurring plans renew month-to-month and are invoiced on the same calendar day each month.

Invoices are payable within fourteen (14) days of issue unless otherwise agreed in writing. Overdue amounts may accrue interest at the maximum rate permitted under Estonian law and may pause active work until cleared.

Recurring plans may be cancelled at any time with thirty (30) days' written notice. Fees already invoiced for the current billing period are non-refundable.

Fixed-scope engagements may be terminated by either party for material breach if the breach is not cured within fifteen (15) days of written notice. Fees for work completed up to the date of termination remain payable.

You agree to provide timely access to assets, information, accounts, and decision-makers required to perform the work. Delays caused by missing inputs do not extend the engagement's billing schedule.

You confirm that you have the rights to any content you ask us to use, and you indemnify Marketarta against third-party claims arising from materials you supply.

Subject to full payment, final deliverables produced specifically for your engagement (e.g. final brand artwork, production source files, deployed code) are licensed to you on a perpetual, worldwide, royalty-free basis for use within your business.

Marketarta retains ownership of preexisting tools, frameworks, templates, internal know-how, and any unselected concepts. We may showcase the engagement in our portfolio unless you ask us in writing not to.

Each party agrees to keep the other's non-public information confidential and to use it only for the purposes of the engagement. This obligation survives termination of the engagement for three (3) years.

We perform our services with the skill and care reasonably expected of a professional studio. To the maximum extent permitted by law, all other warranties — express or implied — are disclaimed, including warranties of merchantability or fitness for a particular purpose.

The Site is provided “as is”. We do not warrant that the Site will be uninterrupted or error-free.

To the maximum extent permitted by law, neither party will be liable for indirect, special, incidental, consequential, or punitive damages arising out of the engagement.

Each party's total aggregate liability under any single engagement is limited to the fees actually paid by you to Marketarta for that engagement during the six (6) months preceding the event giving rise to the claim.

These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-laws principles.

Any dispute that cannot be resolved by good-faith discussion will be submitted to the exclusive jurisdiction of the courts of Harju County, Estonia.

We may update these Terms from time to time. The version in effect on the date of your latest statement of work governs the engagement; the version posted on this page governs your use of the Site.
